Project Working Mom ... and Dads, Too! Scholarship Prize Terms and Conditions

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. THIS SCHOLARSHIP PRIZE IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
The Project Working Mom ... and Dads, Too! Scholarship Prize (the "Scholarship Promotion") starts at 9:00 am (ET) on Sunday, November 1, 2009 and ends at 11:59 pm (ET) on Monday, November 30, 2009 (the "Entry Period"). The sponsor of the prize is EducationDynamics, LLC, 5 Marine View Plaza, Suite 212, Hoboken, NJ 07030 ("Sponsor"). The Scholarship Promotion is subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply.
ELIGIBILITY:
The Scholarship Promotion is open only to legal residents of the 50 United States and the District of Columbia and US Territories. Void outside the 50 United States, and where prohibited or restricted by law. To be eligible, entrant must be at least eighteen (18) years of age or older as of the date of entry. Employees of Sponsor, their immediate family members and those living in the same household, and Sponsor affiliates, subsidiaries, parent and related companies, officers, directors, contractors and agents (collectively, the "Promotion Parties") are not eligible. All federal, state and local rules and regulations apply.
When you enter the Scholarship Promotion, you may be asked to consent to receive promotional e-mails and reminders for promotions and information about online education. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Scholarship Promotion and does not improve your chances of winning.
CHOICE/OPT-OUT:
Scholarship applicants acknowledge that a representative from eLearners.com, EducationDynamics, or one of its representative schools may contact them about enrollment opportunities at an accredited online college. eLearners.com, EducationDynamics, and its subsidiary companies reserve the right to contact registrants for Project Working Mom for future communication and offers from eLearners.com. Users who no longer wish to receive any communication from eLearners.com may unsubscribe and opt out at the following address: http://www.elearners.com/optout/. If users are receiving newsletter communications, users can opt out by clicking on the unsubscribe link in the newsletter.
HOW TO ENTER:
During the Entry Period, you may enter the Scholarship Promotion by going to http://www.projectworkingmom.com/ (the "Entry Site"). You will be asked to provide your name, address, telephone number, date of birth, and e-mail address. You will also be asked to submit a short essay about how you hope to benefit from the Project Working Mom ... and Dads, Too! Scholarship Prize. All entries become the property of the Sponsor and will not be returned. You may enter this scholarship promotion only one (1) time. If multiple entries are received, only the first entry will be included and later entries will be disqualified.
All entries must be received by 11:59 PM (ET) on Monday, November 30, 2009
The Promotion Parties and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, "Released Parties") are not responsible for: any incorrect or inaccurate entry information provided by you; human error; technical malfunctions; failures, omissions, interruptions, deletions, or defects of any internet service provider, network computer online systems, computer equipment, servers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Scholarship Promotion; inability to access any web site including, but not limited to the Entry Site, theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the internet or on any web site. Proof of entering information at Entry Site is not considered proof of delivery or receipt. Illegible and incomplete entries are disqualified. Automated entry attempts will be rejected and may result in disqualification. All entries become property of Sponsor and will not be acknowledged or returned. False and/or deceptive entries or acts, including misrepresentation of age, shall render such entries ineligible. By registering to enter this Scholarship Promotion, you affirm that you have read and accepted these Official Rules. The laws of the United States apply to and govern this scholarship prize and any claims must be raised and resolved in the United States. Any information collected by registering to enter the scholarship prize shall be used only in a manner consistent with these Official Rules and with the Project Working Mom ... and Dads, Too! Scholarship Privacy Policy, which can be viewed at http://www.projectworkingmom.com/.
WINNER SELECTION:
One (1) winner ("Winner") will be selected based on the entry essay on or about Tuesday, December 1, 2009 by judges selected by the Sponsor. All decisions of the judges are final in all matters relating to this Scholarship Promotion.After selection, the Winner will be contacted by phone and email to confirm mailing address. The Winner will have 48 hours to confirm by phone call or email; failure to confirm in this time may result in a new selection by the judges. The Winner will be subsequently notified by overnight mail service and will be required to execute and return a Project Working Mom ... and Dads, Too! Scholarship Award Agreement, an Affidavit of Eligibility/Release of Liability/Publicity Release and other Sponsor required documents within ten (10) days of issuance or an alternate winner will be chosen. By entering and/or accepting the prize, Winner consents (except where prohibited) to the reasonable use by Sponsor of the Winner's photograph, voice, likeness and/or image, hometown address, contents of the entry form and the name and age of the Winner without any further compensation for any future promotional activity related to this and future Scholarship Promotions. Winner will be required to complete and return IRS Form W-9 (Request for Taxpayer Identification Number and Certification) within this same time period. Failure to sign and return all required documents in this time period will result in forfeiture and disqualification of Winner and an alternate Winner will be selected.
PRIZE:
There will be one (1) prize awarded: a $4,000 cash scholarship for the pursuit of an online undergraduate or graduate degree.
The prize will be paid in one lump sum directly to the winner upon verification that the winner applied. Odds of winning depend on the number of eligible entries received. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND EXPENSES, ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. The prize is awarded WITHOUT WARRANTY OF ANY KIND, express or implied, without limitation. If the Winner chooses not to accept his/her prize, an alternate winner may be chosen.
ODDS OF WINNING:
Odds of winning the prize depends upon the total number of eligible entries received.
LIMITATIONS ON LIABILITY:
Released Parties will not be liable to Winner or any other person for failure to supply any prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Released Parties' control.
GENERAL:
By entering this Scholarship Promotion, entrants agree that Released Parties shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Scholarship Promotion or acceptance of or use of or inability to use the prize or parts thereof, including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winner releases the Released Parties from any and all liability and responsibility with respect to the prize (including any property loss, damage, personal injury or death). Winner acknowledges that the Released Parties have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.
If for any reason, this Scholarship Promotion may not be conducted as planned, or if this Scholarship Promotion or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of the Scholarship Promotion and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor's sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Scholarship Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Scholarship Promotion or any portion thereof. In the event this Scholarship Promotion is canceled, terminated, modified or suspended, Sponsor reserves the right to conduct a random drawing to award the prize from among all eligible, non-suspect entries received before the time of the action or event warranting such cancellation, termination, modification or suspension. If such cancellation, termination, modification or suspension occurs, notification will be posted at http://www.projectworkingmom.com/.
All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this promotion, they will indemnify Sponsor from any and all such claims, including the attorneys' fees related thereto.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SCHOLARSHIP PROMOTION IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Where a dispute arises about who submitted an on-line entry, the entry will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met.
NOTE:
Entry must be made by the entrant only at the Entry Site. Entries made by any other individual or any entity, and/or originating at any other internet website or e-mail address will be declared invalid and disqualified from this Scholarship Promotion. The use of any devise, hardware and/or computer software to automate the entry process is prohibited.
All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this promotion, they will indemnify Sponsor from any and all such claims, including the attorneys' fees related thereto.
WINNER LIST:
For an official winner list, (available after Tuesday, December 1, 2009) send a self-addressed, stamped envelope to Project Working Mom ... and Dads, Too! Scholarship, c/o EducationDynamics, LLC, 5 Marine View Plaza, Suite 212, Hoboken, NJ 07030. Winner list requests made ninety (90) days after the selection date will not be honored.
DISPUTES:
This Scholarship Promotion is governed by the laws of the United States without respect to conflict of law doctrines. As a condition of participating in this promotion, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the U.S. having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (e.g. costs associated with entering), and participant further waives all rights to have damages multiplied or increased.
SUBSTITUTION & ASSIGNMENT:
Prize is not transferable or assignable. Sponsor reserves the right to substitute a prize of equal or greater value at its own discretion.
